1. ADOPTER QUALIFICATIONS

The Adopter hereby represents and warrants that:

• They are at least twenty-one (21) years of age;
• They are adopting the kitten(s) for themselves and not on behalf of any other person, organization, or entity;
• All information provided to Kitty’s Kitten Rescue (“KKR”) during the adoption process is true, accurate, complete, and not misleading.

The Adopter understands that KKR relies upon the accuracy of the information provided when making adoption decisions.

Any false statement, omission, misrepresentation, or misleading information provided by the Adopter may result in:

• Immediate denial of the adoption application;
• Immediate termination of this Agreement;
• Revocation of the adoption;
• Repossession of the kitten(s) by KKR without refund; and/or
• Any other remedies available under law or this Agreement.

2. ADOPTION APPROVAL

The Adopter acknowledges and agrees that submission of an adoption application, questionnaire, interview, or any other adoption-related documentation does not guarantee approval for adoption.

KKR reserves the absolute right, in its sole discretion, to approve or deny any adoption application for any lawful reason deemed to be in the best interests of the kitten(s).

The Adopter further understands that KKR is under no obligation to explain or justify any adoption decision.

3. BACKGROUND CHECK

The Adopter acknowledges and agrees that KKR may conduct a background check as part of the adoption review process.

Such review may include, but is not limited to:

• Verification of identity;
• Review of prior animal-related offenses, where permitted by law;
• Verification of residency;
• Review of publicly available information;
• Contacting references provided by the Adopter.

The Adopter authorizes KKR to obtain and review information reasonably necessary to evaluate the adoption application.

4. AUTHORIZATION TO CONTACT REFERENCES

The Adopter hereby authorizes KKR to contact any individual, business, landlord, veterinarian, reference, or other party identified in the adoption application for purposes of verifying information provided by the Adopter and evaluating the suitability of the proposed adoption.

This authorization includes, but is not limited to:

• Landlords or property managers;
• Current or former veterinarians;
• Personal references;
• Emergency contacts;
• Household members, when appropriate.

The Adopter releases all parties contacted by KKR from liability related to the disclosure of information made in good faith for adoption evaluation purposes.

5. ADOPTION FEES AND REQUIRED PAYMENTS

The Adopter agrees to pay all adoption fees, spay/neuter fees, deposits, and any other applicable charges established by Kitty’s Kitten Rescue at the time of adoption.

The Adopter acknowledges that ownership of the kitten shall not fully transfer until all required fees, deposits, and related charges have been paid in full.

Non-Payment of Fees

Failure to pay any adoption fee, deposit, veterinary fee, or other agreed-upon charges shall constitute a breach of this Agreement.

In the event of non-payment, Kitty’s Kitten Rescue reserves the right to:

• • Immediately reclaim possession of the kitten;
  • Seek recovery of all unpaid fees, court costs, attorney fees, and collection expenses;
  • Pursue any legal remedies available under applicable law.

The Adopter agrees to surrender the kitten immediately upon request if payment obligations are not met.

6. SPAY/NEUTER REQUIREMENT

The Adopter agrees that the adopted kitten must be spayed or neutered when the kitten reaches the appropriate age and weight as determined by a licensed veterinarian.

If the kitten has not been altered prior to adoption, the Adopter agrees to comply with Kitty’s Kitten Rescue’s current Spay/Neuter Policy, including payment of any required deposit or fees.

Any required deposit may be refunded upon submission of proof of surgery in accordance with Kitty’s Kitten Rescue policies in effect at the time of adoption.

Failure to comply with the spay/neuter requirement may result in forfeiture of any deposit paid and may constitute grounds for reclaiming the kitten.

7. RETURN OF KITTEN(S)

The Adopter agrees that if, at any time, the Adopter is unable to continue caring for the adopted kitten(s), including but not limited to circumstances such as:

• Moving to a new residence;
• Financial hardship;
• Behavioral concerns;
• Allergies;
• Changes in household circumstances;
• The kitten becoming lost and later recovered; or
• Any other reason preventing continued ownership,

the Adopter must immediately contact KKR.

The Adopter agrees that the kitten(s) shall be returned to KKR.

Under no circumstances shall the Adopter:

• Sell the kitten(s);
• Give away the kitten(s);
• Transfer ownership to another person;
• Surrender the kitten(s) to another rescue, shelter, animal control agency, or organization;

without the prior express written consent of KKR.

KKR reserves the right to reclaim the kitten(s) if this provision is violated.

8. HEALTH AND TEMPERAMENT

The Adopter understands and agrees that KKR makes no guarantees, warranties, or representations, either express or implied, regarding:

• The current or future health of the kitten(s);
• Temperament;
• Personality;
• Behavior;
• Breed;
• Size;
• Future medical conditions; or
• Compatibility with other pets, children, or adults.

The Adopter acknowledges that they are adopting the kitten(s) “AS IS” and assumes all risks and responsibilities associated with the kitten(s)’ health, temperament, and behavior.

9. VETERINARY CARE

The Adopter is solely responsible for all veterinary care required by the kitten(s), including but not limited to:

• Vaccinations;
• Booster vaccines;
• Rabies vaccinations;
• Wellness examinations;
• Flea and parasite prevention;
• Emergency treatment;
• Diagnostic testing;
• Spay/neuter procedures (if applicable);
• Dental care; and
• Any future medical needs.

The Adopter agrees to provide prompt and appropriate veterinary care whenever needed and to maintain the kitten(s) in good health.

KKR shall not be responsible for any veterinary expenses incurred after adoption.

10. PROPER CARE OF KITTEN

The Adopter agrees to:

• Provide adequate food and clean water daily;
• Provide safe indoor housing;
• Protect the kitten from abuse, neglect, and dangerous situations;
• Comply with all applicable animal control laws and ordinances;
• Provide proper socialization and care.

KKR strongly recommends that adopted kittens remain indoor-only pets.

11. RECLAIMING OF KITTEN

KKR reserves the right to reclaim the kitten without refund if KKR reasonably determines that:

• The kitten is being abused, neglected, abandoned, or improperly cared for;
• The Adopter has violated the terms of this Agreement;
• Required fees remain unpaid;
• The kitten has been transferred in violation of this Agreement; or
• The Adopter fails to comply with the spay/neuter requirement.

The Adopter agrees to cooperate fully with any lawful reclaim request.

12. RELEASE OF LIABILITY

The Adopter releases and holds harmless Kitty’s Kitten Rescue, its officers, directors, volunteers, foster caregivers, agents, and representatives from any and all claims, damages, liabilities, losses, costs, or expenses arising from:

• Ownership of the kitten(s);
• Actions or behavior of the kitten(s);
• Injury to persons or property;
• Illness, disease, or medical conditions;
• Veterinary expenses; or
• Any other matter occurring after adoption.
